Europe Calling “Oligarchs and Coal Companies: How ‘Corporate Courts’ Undermine Progressive Policies”

Since the end of TTIP, they have been less in the news, but corporate courts continue to threaten progressive policies in Europe and around the world. Countries are still being sued for billions in these secretive tribunals, bypassing parliaments and the public. Governments are forced to pay up when they phase out coal. Oligarchs use the opaque tribunals to challenge sanctions imposed on them. Billionaires wield tribunal cases to prevent the collection of windfall profit taxes. At the same time, it is European companies who have filed the most cases worldwide.

However, resistance to these secretive tribunals is growing. Many countries have withdrawn from the Energy Charter Treaty, which was responsible for many of the cases. The threat of corporate court cases against the energy transition is now on the agenda of international climate conferences.
